A Powhatan Point man who allegedly attempted to kill his wife by drowning her in their bathtub will go to trial on May 4.

A plea deal was offered, but as of Monday, there's no resolution in the case. John Thomas Sr., 47, was indicted late last year on a slew of serious charges, including attempted murder, kidnapping and two counts of felonious assault.

"Grabbed his wife from the bed, and slammed her against the wall, punched her in the face, broke her nose and then took her into the bathroom, put her in the bath tub and attempted to kill her," Belmont County Prosecutor Dan Fry said.

Thomas's attorney, Edward Gillison, brought forth a number of issues before the court. Gillison requested clarification on the state's expert witness list and expressed concern over a piece of evidence found at the home.

Namely, a letter that the alleged victim claims he wrote.

Belmont County Common Pleas Judge Frank Fregiato said that Thomas, of course, has the right to testify against his wife.

Gillson is said to be filing a motion on his client's right to a speedy trial, which he claims expired Monday. The judge will soon rule in that decision.

Meanwhile, Thomas remains behind bars on a no bond stipulation.
