JEFFERSON COUNTY, Ohio -- The father involved in an Amber Alert from Jefferson County a few weeks ago was back in court Monday afternoon.
The felony charge was changed and Matthew Montgomery was released to return back to his home state of Missouri. He was arrested after authorities tracked him to in Indiana with his 8-year-old daughter.
Defense attorneys say Montgomery had been searching for his daughter, who was living with her mother, for around 5 years.
He found the address. He does have valid custody in West Virginia. He was able to locate the child got time off work stayed in the household for 5 days. During those five days, the child was in the care of her grandmother, and the mother was not present.
That's when Montgomery took the child and authorities believe he intended to take her back to his home in Missouri. That sparked the Amber Alert.
Judge Michael Bednar found him guilty of the misdemeanor charges. Montgomery was sentenced to 6 months with credit for time served.
As far as contact with the child, Montgomery can't see the girl until a new custody order.
