Graham found guilty in sexual abuse case

Updated: Friday, May 16 2014, 06:05 PM EDT

HANCOCK COUNTY, W.Va. --  After 3 and-a-half hours of deliberations, the jury unanimously returned guilty verdicts against Tyler Graham on all three counts in a case in which he sexually assaulted a 22-month old girl.
Graham was found guilty of sexual assault in the first degree, sexual abuse by a custodian, and child abuse resulting in serious or substantial injury.
Graham left the Hancock County Courthouse in a cruiser headed for Northern Regional Jail.
It was in December 2012 when Graham spent the night at his girlfriend's house. He slept in the same bed with his girlfried and the 22-month-old girl. That is when the assult happened.
That assault resulted in the 22-month-old contracting a sexually transmitted disease.
When Graham was interviewed by investigators, he gave five different accounts of the story, ranging from complete denial to accidental sexual contact with the child.
His defense presented a case that he has suffered a medical condition and that he didn't know what he was agreeing to. But Hancock County Assistant Prosecutor David Cross said the physical evidence against Graham in this case was just too much to overlook.
“In my opinion, it's the most heinous crime a person could ever commit,” Cross said. “You can understand circumstances where someone would murder someone else, or someone who would steal from someone. But for someone to intentionally cause harm to a 22-month-old child is just a horrible thing.”
